What the law asks

Royal Decree 933/2021 obliges everyone who rents out accommodation, holiday rentals included, to record each guest's details and report them to the Ministry of the Interior through SES.Hospedajes. Its Annex I lists the data:

  • About you and the rental: owner or company, tax ID, contact details, website and listing link; type of accommodation, name and full address.
  • About the booking: reference, date and signatures; check-in and check-out date and time; the rental's address, number of rooms and whether it has internet; how it was paid.
  • About every guest: name and both surnames, sex, type and number of ID document and its support number, nationality, date of birth, home address, landline and mobile, e-mail, number of guests and, when a guest is under 18, their relationship.

Signatures, deadlines and records

  • Every guest aged 14 or over signs their registration; the details of younger children are given by the adult travelling with them (article 4.2).
  • Send the data at once, at the latest within 24 hours of the booking (or its cancellation) and of the start of the stay (article 6.3).
  • Keep the records for three years after the stay (article 5.3).

In Catalonia and the Basque Country, check with the regional police (Mossos d'Esquadra, Ertzaintza): they run their own registration systems.
